DataMaximus may use, resell, configure, integrate with, or build systems on top of third-party software platforms, including CRM, email, SMS, voice, AI, automation, hosting, analytics, payment, and communication tools.
You understand that some features depend on third-party providers. DataMaximus is not responsible for outages, changes, errors, downtime, price increases, policy changes, or discontinued features caused by third-party platforms.
You may also be required to comply with the terms, policies, and acceptable use rules of those third-party providers.
You may be required to create an account or provide login access to certain systems so DataMaximus can perform services.

Fees for DataMaximus services may include one-time setup fees, monthly subscription fees, usage-based fees, support fees, optimization fees, or other service charges.
By purchasing our services, you agree to pay all fees listed on the applicable checkout page, invoice, proposal, order form, or agreement.

You authorize DataMaximus or its payment processor to charge your payment method for all approved fees.
If you purchase a recurring subscription, your subscription will continue until canceled according to the cancellation policy stated in your agreement, checkout terms, or invoice.
You are responsible for canceling before your next billing date if you do not wish to continue service.
Cancellation of a subscription may result in loss of access to the platform, automations, phone numbers, workflows, funnels, calendars, forms, AI agents, or related services.
Unless otherwise stated in writing, all setup fees, implementation fees, customization fees, consulting fees, and completed service fees are non-refundable.
Subscription fees may be non-refundable once billed, unless otherwise required by law or expressly agreed in writing by DataMaximus.
Because DataMaximus may begin work immediately after purchase, you understand that payments compensate DataMaximus for time, planning, setup, software access, configuration, and implementation work.

You retain ownership of the customer data, lead data, contact information, business information, and other content you provide to DataMaximus or upload into the platform.
You grant DataMaximus permission to access, process, configure, organize, transmit, and use your data as needed to provide services.
You are responsible for ensuring that all data you provide was lawfully collected and may lawfully be used for the intended purpose.
Your use of DataMaximus is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

All DataMaximus branding, website content, systems, frameworks, templates, workflows, training materials, documentation, designs, processes, and proprietary materials are owned by DataMaximus or its licensors.

You agree not to use DataMaximus services for unlawful, harmful, abusive, deceptive, or prohibited purposes.

Support may be provided according to the package, subscription, agreement, or support plan you purchase.
Support may include troubleshooting, system updates, minor changes, training, optimization, or technical assistance.
Unless otherwise stated in writing, support does not include unlimited rebuilds, new funnels, new campaigns, major strategy changes, custom development, emergency support, or work outside the original service scope.
Any project timelines provided by DataMaximus are estimates unless expressly stated as guaranteed in writing.
Timelines may be affected by client delays, missing information, third-party platform issues, technical problems, compliance reviews, domain setup, email/SMS approvals, payment delays, or scope changes.
DataMaximus is not responsible for delays caused by client inaction or third-party providers.
Your package may include a defined number of revisions, updates, or included services.
Additional requests outside the original scope may require additional fees.
DataMaximus may provide a separate quote, invoice, or agreement for expanded services, additional automations, advanced AI agents, extra funnels, custom integrations, or ongoing optimization.
Unless you request otherwise in writing, DataMaximus may reference your business name, logo, general project type, results, or testimonial for marketing purposes.
DataMaximus will not intentionally disclose sensitive confidential information without permission.
Both parties agree to use reasonable care to protect confidential information shared during the business relationship.
Confidential information may include business strategies, customer lists, login credentials, pricing, internal processes, technical information, and proprietary materials.
Confidentiality obligations do not apply to information that is publicly available, independently developed, lawfully received from another source, or required to be disclosed by law.
DataMaximus provides services on an “as available” and “as is” basis unless otherwise stated in writing.
We do not warrant that our website, platform, automations, AI agents, workflows, integrations, or third-party tools will be uninterrupted, error-free, secure, or free from defects.
We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, DataMaximus shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost leads, lost business opportunities, or business interruption.
DataMaximus’ total liability for any claim shall not exceed the amount you paid to DataMaximus for the specific service giving rise to the claim during the three months before the claim arose.

You agree to defend, indemnify, and hold harmless DataMaximus, its owners, team members, contractors, vendors, partners, and affiliates from any claims, damages, losses, liabilities, penalties, costs, or expenses arising from:

Additional fees may apply for account migration, data export, rebuilds, or transfer assistance.
Some platform configurations, automations, templates, phone numbers, AI agents, or proprietary assets may not be transferable depending on the software provider, account structure, or agreement terms.
DataMaximus may update, change, remove, improve, or discontinue any part of its website, platform, packages, pricing, services, features, or offerings at any time.
For existing paid customers, material changes to active services will be handled according to the applicable agreement, subscription terms, or written notice provided by DataMaximus.
We may update these Terms and Conditions from time to time.
The updated version will be posted on our website with a revised effective date. Continued use of our website, platform, or services after changes are posted means you accept the updated Terms.
